General Terms and Conditions of Sale
The present general conditions of sale are applicable to all ticket orders placed through this Internet site.
Therefore, the confirmation of the order for a ticket made through this website implies the Customer’s full acceptance, without reservation, of the present General Terms and Conditions of Sale.
ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU reserves the right to adapt or modify the present General Terms and Conditions of Sale at any time. If changed, the applicable General Terms and Conditions of Sale are those in force on the date when the ticket is purchased.
No special condition or other General Terms and Conditions of Sale emanating from the Customer may prevail over those stated herein without express agreement by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU.
Any contrary condition opposed by the Customer shall therefore be void, in the absence of express acceptance by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU no matter when it has been brought to their attention.
The fact that ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU does not invoke at a given time any one of the present General Terms and Conditions of Sale does not mean they renounce their right to invoke at a later date any of the present Conditions.
It is hereby stated that the event organiser keeps the full and entire ownership of the show tickets. The same applies when ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU intervenes solely on behalf of the organisers/suppliers for the purpose of selling tickets.
As a result, the present General Terms and Conditions of Sale only refer to ticket sale services and not the show or event itself.
We strongly recommend that you print a copy of the present General Terms and Conditions for reference.
ARTICLE 1: Ticket Prices
1.1 The prices of the tickets are shown in Euros and are indicated inclusive of all taxes.
1.2 Rental fees: Should the shows not be organised by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU, rental fees ranging from €1.20 to €2.00 per ticket (all taxes included) shall be charged. However, the price does not include management fees which may be charged at €1 per ticket.
1.3 Rates, including management fees, may be modified at any time by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU. The applicable rates are those in force on the date of the order confirmation.
1.4 Depending on the events, different types of rates may be proposed for one single event. The rate selected by the Customer as well as the price paid with the order confirmation shall not be modified without the express consent of the event organisers.
1.5 When ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU intervenes only as an intermediary of the ticket organisers/suppliers, show tickets shall remain the exclusive property of the event organiser until the full and final collection of the price by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU is made.
1.6 All orders, no matter where they are placed from, are payable in Euros.
ARTICLE 2: Availability and numbers of tickets
2.1 ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU shall inform the Customer in real time about the availability of the requested tickets when the order is being placed. Our algorithm allocates the best seats according to availability.
2.2 The total number of tickets sold per event shall not be superior to the number of tickets set by the organiser. The ticket quota shall be defined for each Event.
2.3 It is hereby stated that the event organisers may lay down conditions of use of tickets and/or rules. Any ticket purchase implies the obligation for the Customer to respect the terms.
2.4 According to the type of show or event, especially regarding sports events, the organiser may reserve the right to provide Customers with a two-stub ticket at the venue. In this case, tickets are to be picked up 30 minutes prior to the show.
2.5 If one or more tickets in the category(-ies) desired by the Customer are unavailable, the latter shall immediately be offered tickets in other category(-ies), within the limits of seats available.
2.6 ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU draws the Customer’s attention to the fact that, considering the number of tickets ordered, the allocated tickets may concern seats divided between the desired category and other categories. The ordered seats may also be part of the same category without being adjacent. Should these seats not suit the Customer, they shall have the possibility to cancel them by clicking on the corresponding button.
2.7 This page only constitutes a pending order and may not be considered as a firm and final booking until payment is made. Depending on each event, it is possible that the organiser, or ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU, sets a maximum quota of tickets available for booking, accumulated per purchase. This quota will be defined when required. One single Customer cannot place several orders at different times to circumvent this rule.
ARTICLE 3: Location of seats
In the process of booking, the Customer may view the seats on a seating map, if available, and if they are numbered. Seats shall be displayed on the map by category and subcategory. The seating map may not be considered as a contractual commitment by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU.
The seating map is given for information purposes only and aims to be as representative as possible. However, depending on the real dimensions of the hall depicted on the map, the location shown may not be representative of precise seats but of a group of seats that includes those seats wanted by the purchaser.
ARTICLE 4: Methods of payment
4.1 All payments are to be made exclusively by credit/debit card.
4.2 Online payment is made solely by CARTE BLEUE/VISA or EUROCARD/MASTERCARD.
4.3 The order amount shall be debited from the Customer’s bank account when the transaction is fully confirmed.
4.4 Following each transaction, the Customer shall be provided with proof of payment. This document shall be sent to their personal space which is automatically created on the Internet site.
4.5 Each bank transaction leads to the creation of one single ticket. Each ticket is for a specific person and cannot correspond to several seats. In the case of a collective purchase, tickets are all generated one after the other as a single PDF file.
ARTICLE 5: Order confirmation
5.1 The confirmation of the order for a ticket made through this site leads to the final and binding completion of the contract and implies the Customer’s acceptance without reservation of the present Terms and Conditions of Sale.
5.2 Unless the contrary is proven, the data registered by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU constitutes evidence of the totality of the orders placed between the latter and the Customers.
5.3 A confirmation e-mail shall be sent to the Customer in order to validate their booking.
ARTICLE 6: Protection of personal data
6.1 PROTECTION OF PAYMENTS
This website is secured by a payment protection system which uses the SSL encryption protocol that guarantees the privacy of Customers’ bank details.
This technology does not carry any risk of piracy. The payment data is encoded from your computer to the bank server.
In order to secure these payments, ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU uses the PPPS solution provided and created by PAYBOX company.
6.2 PERSONAL DATA
During the order process, the Customer may be required to indicate certain personal data which may be used by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU for management and follow-up procedures relating to the order.
In order to improve the promptness of service, this data will be kept by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU for security purposes and will be used each time the Customer logs on.
Information and data is also kept in each Customer’s personal online space by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU in order to better transmit the information sent by organisers, especially in the event of postponement or cancellation of an event relative to the customer’s order.
Furthermore, this data is also used in order to allow ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU to improve and customise their services, especially through newsletters (information letters) which shall be sent to Customers, should they have authorised it.
If the Customer refuses to receive newsletters, they shall have to untick the corresponding box.
Furthermore, in the event of subscription to the newsletter, the Customer shall unsubscribe at any time by sending an email to ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU at the following address: 60 chemin des Sables, 06160 Juan-les-Pins, France.
In accordance with the Data Protection Act of the 6 January 1978 amended by the law of the 6 August 2004, the Customer has a right to access and modify data concerning them as well as the right to object to the processing of their data.
ARTICLE 7: Absence of the right of retraction
In accordance with article L. 121-20-4 of the French Consumer Code, the show tickets needing to be provided at a given date or period are not subject to the right of withdrawal.
ARTICLE 8: Restrictions in using the tickets
8.1 To be valid, tickets shall be printed in grey scales or in colour on A4 blank white paper format, on the front page, in portrait orientation without changing the size. No other medium shall be accepted.
8.2 tickets can be printed from any place as long as there is an Internet connection.
8.3 Checks of ticket validity will be carried out at the event venue.
8.4 A good print quality is necessary. Partially printed, dirty, damaged or illegible tickets shall not be accepted and shall be considered as not valid.
8.5 Should there be an incident or should the print quality be poor, the Customer shall reprint their ticket. To check whether the print quality is good, the Customer must ensure that information written on the ticket and the barcode are legible.
8.6 Any ticket purchased may be neither exchanged nor refunded except in the case of cancellation of the event. In this case, the ticket will be refunded but both the management fees and rental fees shall be retained.
8.7 Tickets are personal and non-transferrable. The organiser reserves the right to check the identity of the Customer at the entrance to the event venue. For this check, the Customer must be able to show a currently valid, official identity document with a photo (identity card, passport, driving licence or residence permit).
Family record books are accepted for children.
8.8 ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU draws particular attention to the fact that no ticket may be sold or transferred, even free of charge by the Customer except if a written request has been addressed to and expressly accepted by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU.
8.9 The ticket check shall be carried out under the exclusive responsibility of the organiser by means of barcode readers at the venue of the event. Each Customer shall be in possession of a personal secured ticket. If a ticket is falsified, in any manner whatsoever, only the first ticket presented and scanned shall be considered as valid and shall enable the Customer to access the show.
8.10 Barcodes enable the identification of the Customer and give access to their order details.
8.11 Furthermore, it is reminded that the individual(s) who falsify a ticket as well as the false ticket beneficiary may be liable to criminal prosecution.
8.12 In the event of ticket reproduction, theft or falsification, the organiser reserves the right to refuse access to the performance venue to the individual(s) holding these tickets if access to the performance venue has already been granted to the valid ticket holders. In this case, the individual who has been refused the access to the event shall not be entitled to a refund.
8.13 The ticket is only valid for the event and date indicated thereon, under the conditions indicated thereon. Once the event has started, no claim will be accepted regarding the applicable price or the event itself.
8.14 The Customer must keep their ticket to be able to present it at any check.
8.15 The ticket purchased implies the full acceptance of the rules specific to the venue of the event.
8.16 ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU may not be held liable for any failure which may occur during the ordering, processing or printing of the ticket insofar as they have not caused this intentionally or as a result of neglect in the event of loss, theft or illegal use.
8.17 Should the above rules be not respected, the Customer’s ticket shall be declared invalid.
8.18 At the end of each transaction, the purchaser will be able to consult and print their tickets from the user account which has been automatically assigned to them on the Internet site.
ARTICLE 9: Cancellation, modification and refund
9.1 In case of loss or theft, the ticket cannot be reimbursed. Furthermore, the tickets cannot be returned or exchanged except in the event of cancellation of the show and the express decision of the organiser to reimburse Customers.
In the event that the show is cancelled or a decision made by the organiser to refund purchasers, only the price of the ticket will be refunded.
In this case, refunds shall be addressed to the initial purchaser of the ticket only in exchange for the ticket.
In all cases, no other expense of any typecan be refunded and no compensation given.
It is hereby stated that any purchased ticket, even unused, cannot be refunded except in the event of cancellation and under the conditions set out above.
WARNING ABOUT UNLAWFUL TICKET RESALE :
In 2012, a law no. 2012-348 was voted – this forbids the reselling of tickets, without the express permission of the organisers or producers of the entry tickets to shows, sporting, cultural and commercial events.
Non-respect of this article 313-6-2 is covered by the Penal code and punished by a 15,000€ to 30,000€ fine.
Do not buy tickets from a person who is not able to guarantee that he has the authorisation of the show producer.
Otherwise, you may find yourself without help if the tickets are not delivered, or the tickets delivered do not give you access to the show.
The producer’s name is marked on all tickets issued. Contact them and especially use the producer’s website.
During ticket checks at the entrance to the event, proof of ID bearing a photo and currently valid may be requested, and this must correspond to the name written on the ticket if the ticket is nominative.
9.2 Payment refunds for cancelled events are addressed to the initial purchaser of tickets, according to the terms of TRESOR PUBLIC, ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU’s accountant.
9.3 Organisation and delivery of events are subject to the sole responsibility of organisers. As a result, ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU shall not be held liable in the event of cancellation, postponement, modification of programme or venue of the event and more generally in all the organiser’s decisions which may affect the delivery of events.
In the event of cancellation of an event, rental and management fees shall be, in any case, retained by ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU.
9.4 In the event of a modification as stated in 9.3, the Customer accepts that ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU uses the Customer’s personal details provided during the ordering process in order for them to be kept up to date regarding the modifications and the steps which need to be taken.
9.5 For this purpose, the company ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU strongly recommends that Customers contact them or the organiser, at least 24 hours prior to the event, to check whether the event is maintained.
ARTICLE 10: Responsibility
10.1 In accordance with the legislation in force, article L. 121-20-3 of the French Consumer’s Code, ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU is fully liable to the Customers, for the proper performance of the obligations arising from the distance contracts.
10.2 Each event organiser determines the specific rules of the organisation of the event which shall be applicable to all customers.
These rules are communicated by the organiser directly to Customers, through their website, or directly at the venue of the event.
10.3 ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU recommends that Customers ensure that their electronic mail spam filter does not block the receipt of any confirmation emails sent by the company.
ARTICLE 11: Applicable law - Litigation
11.1 The ticket orders placed through ANTIBES JUAN-LES-PINS TOURISM AND CONVENTION BUREAU Internet site are subject to French law only.
11.2 Should an amicable solution not be possible, any legal action shall fall within the jurisdiction of the competent French courts.
